Auckland lawyer fined for unsatisfactory conduct

An Auckland Lawyer has been fined after an unsatisfactory conduct ruling by the New Zealand Lawyers and Conveyancers Disciplinary Tribunal.

Bohsoon Kang has been fined $5,000 by the tribunal and will also pay costs of $16,299.20 to the New Zealand Law Society. He must also undertake a trust account supervisor refresher course within the next 12 months.

The Law Society found shortcomings in the trust account of Kang’s law firm for 2008, 2012, and 2016. A follow up inspection in 2017 revealed several deficiencies in his trust account records and practices, the Law Society said.

The lawyer has been ordered to remedy the shortcomings in his trust account practices after his misconduct. The issues identified include monthly reconciliations and account imbalances, failures to report to clients, and failures to address unpresented cheques.

Kang admitted during cross-examination that he was not familiar with trust accounting regulations and needed to learn. He said he did not focus on the requirements seriously enough and has now realised his obligations.
