Government launches review of legal aid system to ensure accessibility and efficiency

The government has announced a review of the legal aid system to address concerns about its sustainability and effectiveness, Justice Minister Paul Goldsmith confirmed.

In a news release, the justice minister said that the review aims to ensure that legal aid remains accessible, efficient, and cost-effective while prioritising victims' access to justice.

Goldsmith acknowledged that legal professionals, the judiciary, and other stakeholders have raised concerns about challenges within the current system. The justice minister noted that the judiciary, legal professionals, and other stakeholders have expressed the need for changes to address challenges affecting both legal aid providers and those relying on their services.

The legal aid scheme was last reviewed in 2018. Since then, it has experienced significant increases in spending, reflecting the demand in the courts. Goldsmith emphasised the need for an updated assessment to ensure the system operates efficiently and sustainably.

In his statement, Goldsmith emphasised the government's responsibility to ensure that individuals who cannot afford a lawyer still have access to legal advice and representation, highlighting the importance of a fair and transparent justice system.

The review will be led by the Ministry of Justice, which will consult with the public and the legal profession. It will focus on key concerns that have been consistently raised by stakeholders. These include the sustainability of the scheme, quality assurance of legal aid providers, provider incentives and remuneration, as well as eligibility and repayment settings.

Goldsmith has instructed the ministry to prioritise these areas to improve the overall effectiveness of the legal aid system. The government expects to communicate decisions following the review in 2026.
