High profile criminal lawyer Michael Bosscher is facing professional misconduct charges after he tendered a report in 2012 at an inquiry which contained defamatory material of chief justice Catherine Holmes.
NSW justice Clifton Hoeben today reserved his decision over whether or not to discipline him to a later date, according to a report by AAP.
The Queensland Civil and Administrative Tribunal hearing revealed that Bosscher knew about the material but his lawyers argued he was obligated to tender it for the benefit of his client.
Legal Commission lawyers said he had “failed to exercise appropriate forensic judgment”, given that the document accused Holmes of criminal activity and called for her removal from the bench.
Holmes lodged a complaint with the commission back in 2013, before she was promoted to top judge.
