One of the new partners leads the firm’s local government and environmental practice
Luke Cunningham Clere (LCC) has expanded its partnership with the addition of Tim Bain and Emma Ferrier, reported the New Zealand Law Society.
Bain specialises in litigation and public law. As a senior Crown prosecutor, he has conducted jury and judge-alone trials for the Crown and public bodies as well as professional disciplinary proceedings.
He has represented public organisations in the event that decisions are appealed. He has also provided guidance on statutory powers and duties, as well as provided support in legal investigations. He has advised on enforcement options, the exercise of statutory powers, and compliance with common law and the statutory obligations governing the exercise of public power.
Bain is on the Courthouse Committee of the New Zealand Law Society and was part of the Law Reform Committee. Prior to joining LCC, he completed a clerkship for the then-Chief Justice at the Supreme Court.
Ferrier heads up the local government and environmental practice at LCC. She has considerable experience in environmental law, regulatory enforcement, and civil litigation, focusing on local government clients.
She has served as lead counsel in serious crime jury trials as a senior Crown prosecutor. She has appeared before the Court of Appeal, High Court and District Court.
Ferrier has tackled enforcement matters on behalf of councils, insurance disputes relating to natural disasters like the Canterbury Earthquake Sequence, and enforcement under the RMA. She has represented clients in civil pecuniary penalty proceedings and investigations by the Commerce Commission, FMA and the Reserve Bank.
